Terms of Service

1. Acceptance of these terms
These Terms of Service (the “Terms”) form a binding agreement between you (“you”) and Swiss Commerce (“we,” “us,” or the “Service operator”), governing your use of the KPI Dashboard application (the “Service”). By signing in or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Account and access
Access requires sign-in with Google. Each Google identity corresponds to one user account. The user who creates a new organization is its initial owner; you are responsible for inviting, removing, and supervising members of any organization you administer.
3. Acceptable use
You agree not to:
- Use the Service for unlawful purposes.
- Connect databases or Google accounts you are not authorized to access.
- Attempt to bypass tenant isolation, RLS policies, rate limits, or any security controls.
- Reverse engineer, scrape, or otherwise misuse the Service in a way that interferes with others’ use.
- Use the Service to send spam, attack third-party systems, or transmit malware.
4. Your data and content
You retain all rights to the data you connect or create in the Service. By using the Service, you grant us a limited license to access, transmit, and display that data solely as necessary to operate the Service for you. We do not claim ownership of your content and will not use it to train machine-learning models or for advertising.
5. Third-party services
The Service connects to third-party platforms (Google, Supabase, and any database you choose to add). Your use of those platforms is governed by their own terms. We are not responsible for the availability, accuracy, or behavior of third-party services.
6. Service availability
We provide the Service on a best-effort basis. We may modify, suspend, or discontinue all or part of the Service at any time. We do not promise uninterrupted availability and will not be liable for downtime, data loss, or third-party-service outages.
7. Fees
The Service may be offered free of charge or under specific commercial terms agreed separately with you. If paid plans are introduced, they will be governed by an addendum to these Terms.
8. Termination
You may stop using the Service and delete your data at any time. We may suspend or terminate access if you violate these Terms or if required by law. On termination, we delete your account and associated tenant data on the timeline described in our Privacy Policy.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE SERVICE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnity
You agree to indemnify and hold the Service operator harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to its conflict of law principles. Any dispute will be resolved exclusively in the competent courts of that jurisdiction.
13. Changes
We may update these Terms from time to time. Material changes will be announced in-app or via email. Continued use of the Service after a change constitutes acceptance.
